9. (1) Where a body corporate commits an offence under this Act or any regulations made under it, and that offence is proved to have been committed with the consent or connivance of, or to be attributable to any neglect on the part of —
a director;
manager;
secretary or other similar officer of the body corporate; or
a person who was purporting to act in any such capacity, that person, as well as the body corporate, commit that offence and are liable to be proceeded against and punished accordingly.
Where the affairs of a body corporate are managed by its members, subsection
shall apply in relation to the acts and defaults of a member in connection with that member’s functions of management as if that member were a director of the body corporate. Merchant Shipping Act, 2024 Section 10 c Act 1 of 2024 Page 29
