40. A person who —
acts, or suffers a person under the first mentioned person’s control to act, in contravention of section 39, or
omits to do, or suffers a person under the first mentioned person’s control to omit to do, anything required by that section, commits an offence and is liable on summary conviction to a fine of three thousand dollars, and, except in the case of an application being made under section 39 with respect to a foreign ship which, not having at any previous time been registered as a Cayman Islands ship, has become a Cayman Islands ship, the ship may be detained until there is compliance with that section.
