39. (1) A ship shall not be described by a name other than that which it is for the time being registered.
A change shall not be made in the name of a ship without the previous written permission of the Registrar of Shipping.
Application for permission under subsection (2) shall be made by the owner of the ship, or by a representative of the owner of a ship in writing and, if the Registrar of Shipping is of the opinion that the application is reasonable, the Registrar of Shipping may grant permission, and may thereupon require notice of the permission to be published in such form and manner as Registrar of Shipping thinks fit.
On the grant of permission under subsection (3), the ship’s name shall forthwith be altered in the register, in the ship’s certificate of registry and on its bows and stern.
If it is shown to the satisfaction of the Registrar of Shipping that the name of a ship has been changed without the permission of the Registrar of Shipping, the Registrar of Shipping shall direct that that its name be altered to that which it bore before the change, and the name shall be altered in the register, in the ship’s certificate of registry and on its bows and stern accordingly.
