When Justices may abstain from adjudicating

In case the Justices find any misdemeanour complained of under this Law to have been accompanied by any felonious intent, or otherwise in their discretion consider the same ought to be prosecuted by indictment they shall abstain from any adjudication thereupon, and shall deal with the case in all respects in the same manner as if this Law had not been passed.
