Person causing hurt or damage while committing offence

Every person who by committing any offence herein forbidden, has caused any hurt or damage to any person or property, who does not upon demand make amends for such hurt or damage to the satisfaction of the person aggrieved, shall, upon conviction for the offence, pay such a sum not exceeding sixty dollars as appears to the Justices before whom he is convicted to be reasonable amends to the person aggrieved, besides any penalty to which he may be liable for the offence; and the evidence of the person aggrieved shall be admitted in proof of the offence: Provided always, that, if the person aggrieved was the only witness examined in proof of the offence, the sum ordered as amends shall be paid and applied in the same manner as the penalty.
