Guidance about monetary penalty orders

The Commissioner shall prepare and issue guidance, after consultation with Cabinet, on the exercise of the Commissioner’s functions under section 55.

The guidance shall, in particular, deal with —

the circumstances in which the Commissioner would consider it appropriate to issue a monetary penalty order; and

how the Commissioner will determine the amount of the penalty.
