Failure to comply with order

Subject to subsections 47 and 48, a person who fails to comply with an information requirement, enforcement order or monetary penalty order under this Law commits an offence and is liable on conviction to a fine of one hundred thousand dollars or to imprisonment for a term of five years, or both.
It is a defence for a person charged with an offence under subsection (1) to prove that all due diligence has been exercised to comply with the information requirement, enforcement order or monetary penalty order in question.
