Determination of age of young persons

8. (1) Where —
a person (whether or not charged with an offence) is brought before any court in any criminal proceedings otherwise than for the purpose of giving evidence; and Youth Justice Act (2021 Revision) Section 9 c Revised as at 31st December, 2020 Page 11
it appears to the court that that person is a young person, the court shall make due enquiry as to that person’s age.
Where —
an enquiry under subsection (1) has been made; and
as a result of the enquiry it appears to the court that the person has not attained the age of seventeen, that person shall be deemed to be a young person for the purpose of the proceedings.
The age of a young person determined as a result of the enquiry shall be deemed, for the proceedings concerned, to be the true age of that person.
Any order made by a court shall not be invalidated by subsequent proof that the age of a person under this section was not correctly determined.
