A body corporate shall not describe itself as a body corporate for the time being recognised under section 22 unless it is so recognised.
A body corporate which contravenes subsection (1) commits an offence and is liable on summary conviction to a fine of five thousand dollars.
Where an offence under subsection (1), which has been committed by a body corporate, is proved to have been committed with the consent or connivance of, or to be attributable to any neglect on the part of, any director, manager, secretary or other similar officer of the body corporate, or any person purporting to act in any such capacity, that person, as well as the body corporate, commits an offence and is liable to be proceeded against and punished accordingly.
