Pre-contract disputes

Where, during negotiations for the provision of interconnection or infrastructure sharing , there is any dispute between the parties (hereinafter in this section referred to as the "pre-contract dispute") as to the terms and conditions of such provision, either of them may refer the dispute to the Office for resolution.
The Office may make rules applicable to the resolution of pre-contract disputes by means of arbitration or other dispute resolution mechanisms.
A decision of the Office in relation to any pre-contract dispute shall be consistent with any agreement reached between the parties as to matters that are not in dispute.
