Recalling a witness

The Judge shall have power in the Judge's discretion at any stage of the trial, prior to the conclusion of the summing up, to call any witness, whether or not such witness has been called before the court in the course of the trial or not and to examine such witness. If a witness for the Crown is recalled by the Judge or by leave of the Judge, the accused or the accused's counsel shall be allowed to cross-examine the witness on the new evidence given. In any other case a witness called under this section may only be cross-examined by either party with the leave of the Judge.
