Powers of magistrate when imposing a fine

A Summary Court, upon recording a conviction by which any sum is adjudged to be paid, may —
order imprisonment in the first instance unless such sum be paid forthwith;
allow time for the payment of the said sum;
direct payment to be made of the said sum by instalments;
direct that the person liable to pay the said sum shall be at liberty to give, to the satisfaction of the court or such person as may be specified by the person so liable, security, with or without a surety or sureties, for the payment of the said sum or of any instalment thereof, and such security may be enforced in the same manner as the payment of a fine;
issue a warrant of distress for the levying of the said sum;
order imprisonment in default of sufficient distress or of the payment of any instalment:
subject to any other law, a sentence of imprisonment imposed by a Summary Court for non-payment of a fine shall not exceed five years.
Where a Summary Court has allowed time for the payment of any sum under paragraph (b) of subsection (1), it may, on application by or on behalf of the person liable to make the payment, allow further time for payment, or may direct payment of such sum by instalments.
