If, during the course of a trial before a Summary Court, in any case which may be tried summarily or on indictment it appears to the magistrate that the case is one which ought to be tried on indictment, the court may, upon application made by the prosecution or the accused person, stay all further proceedings in respect of the trial and in lieu therefor may hold a preliminary inquiry in accordance with this Code.
