Retention of vehicles

87. Where a person has been charged with an offence under section 82 or 83, the Commissioner may retain at a vehicle pound or police station a vehicle used in the commission of the offence for —
eighteen hours;
until it appears to a constable that, were the person at the time driving or attempting to drive a vehicle on a road, that person would not be committing an offence under section 82; or
for such period as the Commissioner may, in the Commissioner’s discretion, direct, whichever period is the longest.
