Persons not to drive vehicle unless licensed or authorised

A person who drives a vehicle on a road while not being licensed or authorised under this Act to drive that vehicle commits an offence and is liable on summary conviction to a fine of four thousand dollars or to imprisonment for twelve months, or to both.
Where a person is charged —
with a contravention of subsection (1), the burden of proving that that person was licensed or authorised lies on that person; and
with being an accessory to a contravention of subsection (1), the burden of proving that the person who was driving was licensed or authorised lies on the alleged accessory.
