Presumption of survivorship

In all cases where, on or after the 23rd March, 2006, the commencement date of the Succession (Amendment) Act, 2006 [Law 2 of 2006], two or more persons have died in circumstances rendering it uncertain which of them survived the other or others, such deaths shall for all purposes affecting the title of property, be presumed to have occurred in order of seniority, and accordingly the younger shall be deemed to have survived the elder.
In subsection (1) —
“property” includes any chose in action, and any interest in real or personal property.
