Where a petition contains a prayer for general damages or costs against a co-respondent and the Court —
pronounces a decree of dissolution of the marriage, or civil partnership;
finds that such co-respondent has committed adultery with the respondent;
finds that the conduct of such co-respondent has contributed materially to the breakdown of the marriage, or civil partnership,
the Court may, as the case may be, order the co-respondent to pay the whole or such proportion of the costs of the suit and such damages as appears just and shall, at its discretion, allocate the damages to the petitioner or to any settlement for the benefit of the children of the marriage, or civil partnership.
