A person who fails to comply with a requirement imposed on that person under section 42 or 43 commits an offence.
Where a person is charged with an offence under subsection (1) in respect of a requirement to produce a document, it is a defence for that person to prove —
that the document was not in that person's possession or under that person's control; and
that it was not reasonably practicable for that person to comply with the requirement.
Where a person is charged with an offence under subsection (1) in respect of a requirement —
to provide information;
to provide an explanation of a document; or
to state where a document is to be found,
it is a defence for that person to prove that that person had a reasonable excuse for failing to comply with the requirement.
Failure to comply with a requirement imposed under section 42 is not an offence if the person imposing the requirement has failed to act in accordance with that section.
A person who intentionally obstructs an officer acting in the exercise of that officer's powers under section 43 commits an offence.
A person who commits an offence under subsection (1) or (5) is liable, on summary conviction, to a fine of four thousand dollars and on conviction on indictment to a fine.
A person who intentionally obstructs an officer in the exercise of that officer's powers under a warrant issued under section 43 commits an offence and is liable on summary conviction to a fine of four thousand dollars and, if that person is convicted on indictment, to a fine and imprisonment for two years.
