Engaging in ICT activities without a licence

A person who operates an ICT network or provides ICT services specified in accordance with section 23(2) contrary to that section commits an offence and is liable, on conviction on indictment, to a fine of fifty thousand dollars and to imprisonment for five years, and if the offence is a continuing one to a further fine of ten thousand dollars for every day or part of a day during which the offence has continued.
The Court may also, on application —
make an order for forfeiture of any equipment used for the commission of the offence; and
grant an order restraining the accused from continuing to engage in similar activities.
