Onus of proof

If any person is found in possession of a lottery ticket, the onus of proof shall be upon the person in whose possession the same is found to prove that the lottery ticket —
is not in fact a lottery ticket; or
was not bought or obtained in connection with a public lottery or a lottery.
A person who is found in possession of a lottery ticket and fails to prove any of the facts set forth in subsection (1) commits an offence and is liable on conviction to a fine of twenty dollars or to imprisonment, with or without hard labour, for three months.
