Complainant and witnesses to be bound over

When an accused person is committed for trial before the Grand Court, subject to this Code and the Evidence Act (2021 Revision), with regard to witnesses who are about to leave the Islands or who are ill, the court committing the accused person shall bind by recognisance, with or without sureties as the court may deem requisite, the complainant and every witness to appear at the trial to prosecute or to prosecute and give evidence or to give evidence, as the case may be: Provided that if the complainant is acting on behalf of the Crown, the Director of Public Prosecutions, the Commissioner of Police or any department of the Government or is a public officer acting in that public officer's official capacity that person shall not be required to be bound by any recognisance or to give any security.
