Summary adjudication in certain cases

If, at the close of or during the preliminary inquiry, it shall appear to the court that the offence is of such a nature that it may suitably be dealt with under the powers possessed by the court and is not a case in which the accused having a right to elect to be tried on indictment has so elected, the court may, subject to this Code, hear and finally determine the matter and either convict the accused person or dismiss the charge: Provided that in every such case the accused shall be entitled to have recalled for further examination all witnesses whom the accused may require.
