A person who causes a computer to perform a function for the purpose of securing access without authority to information held in a computer with intent to commit an offence to which this section applies or to facilitate the commission of such an offence (whether by himself or by any other person) commits an offence and is liable on summary conviction to a fine of $30,000 or to imprisonment for a term of seven years, or to both.
This section applies to offences —
involving —
property;
fraud; or
dishonesty; or
which cause bodily harm, and which are punishable on conviction with imprisonment for a term of two years or more.
For the purposes of this section, it is immaterial whether the offence to which this section applies is committed at the same time as the unauthorised access is secured or on any future occasion.
A person may be guilty of an offence under this section even though the facts are such that the commission of the further offence is impossible.
