If on the trial of a person charged with an offence under section 4, 5, 6 or 7 or any related inchoate offence, the court finds him not guilty of the offence charged they may find him guilty of an offence under section 3 or any related inchoate offence if on the facts shown he could have been found guilty of that offence.
