Practising without a licence to be an offence

A person shall not offer services as a public accountant or engage in public practice, either as a partner, director or person holding an equivalent position in a firm of public accountants or as a sole practitioner, from or within the Islands unless the person is the holder of a valid licence issued under section 11 or 12.
A firm or company shall not offer services as a firm of public accountants or engage in public practice, unless each partner, director or person holding an equivalent position engaged in public practice, from or within the Islands, in the firm or company is the holder of a valid licence issued under section 11 or 12.
A person who contravenes subsection (1) or (2) commits an offence and is liable on summary conviction to a fine of one hundred thousand dollars or to imprisonment for a term of one year, or to both.
Where an offence under this section which has been committed by a firm or company is proved to have been committed with the consent or connivance of, or to be attributable to any neglect on the part of, any partner, director, manager, secretary or other similar officer of the firm or company, or any person who was purporting to act in any such capacity, the person as well as the firm or company commits that offence and is liable to be proceeded against and punished accordingly.
Where the affairs of a firm or company are managed by its members, subsection (4) shall apply in relation to the acts and defaults of a member of the firm or company in connection with the member's functions of management as if the member was a partner or director of the firm or company.
This section shall not apply to public officers acting in their capacity as such.
