If an employer on whom notice of the accident has been served as aforesaid does not within four weeks after the receipt of the notice agree in writing with the workman as to the amount of compensation to be paid, the workman may make such application as in this Law is provided for enforcing his claim to compensation:
the Court may grant leave to the workman to make such application before the expiration of the period of four weeks specified in this section if the Court is satisfied that the workman is likely to suffer hardship in establishing his claim for compensation after the expiration of the said period by reason of the fact that the employer is about to leave the Islands or to do some other act prejudicial to the claim of the workman.
