Remedies for failure to comply with notice

Subject to section 45, if any person on whom a notice is served by the Chief Environmental Health Officer fails under that section to take any steps required by the notice at the time or within the period prescribed by the notice, the Chief Environmental Health Officer may take those steps and recover from that person any expenses reasonably incurred in doing so.
Without prejudice to subsection (1), but subject to section 45 with respect to appeals, whoever fails to take any steps as aforesaid commits an offence and is liable on conviction to a fine in the case of a first offence of one hundred dollars, and in the case of a second or subsequent offence of five hundred dollars.
