14. (1) The Police Association shall continue in being, and its purpose shall be to enable police officers to consider and bring to the notice of the Government any matter affecting their welfare and efficiency other than questions of discipline and promotion; and the Association shall be entirely independent of, and unassociated with, any body or person outside the Service, and shall be deemed not to be a trade union within the meaning of the Trade Union Act (2019 Revision).
Subject to subsection (1), a police officer shall not become a member of any trade union, or of any association the object or one of the objects of which is to control or influence the pay, pensions or conditions of service of any police service or body or of the public service of the Islands or of any association with political objects; and a police officer who contravenes this provision commits an offence and is liable on summary conviction to a fine of three thousand dollars or to imprisonment for one year or to both.
Any question whether a body is a trade union or association to which subsection (2) applies shall be determined by the Governor and such determination shall be final and conclusive and shall not be questioned in any court or other proceedings whatsoever.
