A notary public shall not charge for the performance of any notarial act a sum in excess of the fees listed in Schedule 5, and where a notary public provides a service or carries out an act for which fees are not provided, the notary public's fees shall be as provided for under any rules of court or any other written law.
Where the provisions of subsection (1) are contravened, the notary public's conduct shall be considered as misconduct in that person's capacity as a notary public.
