75. Whoever represents that he holds an exclusive prospecting licence or mining lease and thereby induces or attempts to induce any person to buy any interest in such licence or lease or to invest capital in any company or syndicate connected therewith, before he has obtained the grant of such licence or lease, or when such licence or lease has been forfeited, revoked or determined, as the case may be, is liable to forfeit any right to the grant of such licence or lease where such has been applied for and, if he is already the holder of a prospecting right, licence, or mining lease, is liable to have such right, licence, or lease revoked: Provided that nothing in this section shall relieve any person from liability to civil action or criminal prosecution in respect of such representation.
