Liability of officers

If an offence under this Act that has been committed by a partnership, limited liability partnership or body corporate is proved to have been committed with the consent or connivance of, or to be attributable to any wilful neglect on the part of a person —
who is a partner of the partnership or limited liability partnership, or a director, manager, secretary or other similar officer of the body corporate; or
who is purporting to act in any such capacity,
that person also commits the offence and is liable to be proceeded against and punished accordingly.
If the affairs of a body corporate are managed by that body corporate's members, subsection (1) shall apply in relation to the acts and defaults of a member in connection with the member.
