A person who discloses any information —
relating to the affairs of the Authority;
relating to the affairs of a relevant entity;
relating to the affairs of any officer, customer, investor, member, client or policyholder of a relevant entity; or
shared by or with a competent authority or any communication related thereto,
Subsection (1) shall not apply to a disclosure —
lawfully made in accordance with section 3(1) of the Confidential Information Disclosure Act, 2016 [Law 23 of 2016];
if the information disclosed is or has been available to the public from any other source;
where the information disclosed is in a summary or in statistics expressed in a manner that does not enable the identity of any relevant entity, or of any officer, customer, investor, member, client or policyholder of a relevant entity to which the information relates to be ascertained; or
by the Authority under this Act.
