Issuance of certificate re exempt record

Where —
the Governor is satisfied that an application for access relates to a record specified in section 20(1)(a); or
a Minister is satisfied that an application for access relates to a record to which sections 15, 16, 17(1)(c), 20(1)(b), 20(1)(d) and 22, as the case may be, applies,
the Governor or the Minister, as the case may require, may issue a certificate to the effect that the record is an exempt record and shall specify the basis of the exemption.
Where the Governor or a Minister is satisfied as mentioned in subsection (1) by virtue of anything contained in any particular part or parts of a record, a certificate issued under that subsection in respect of that record shall identify that part or those parts of the record by reason of which the certificate is issued.
Where a certificate is issued under subsection (1)(a) under the hand of the Governor, it shall be conclusive that the record is exempt and no judicial proceedings or quasi-judicial proceedings of any kind shall be entertained in relation thereto.
Where a certificate is issued by the Governor or a Minister, under subsection (1), the Ombudsman shall be notified of the issuance of the certificate.
