Except as provided in subsection (2), any person who, not being registered under this Law, uses or adopts any style, title or description which implies that such person is so registered commits an offence and is liable on summary conviction to a fine of two thousand dollars and, in addition, to a mandatory fine of two hundred and fifty dollars for every day on which the offence continues and on a second conviction to a like fine or imprisonment for three months, or both.
Subsection (1) does not apply to a person —
who, having had that person's name removed from the register, has not yet been given notice in writing by the Board of its removal; or
in respect of whom a decision under section 15 or 24 has been taken by the Board and such decision has not taken effect.
