Cases in which employer may alter half-monthly payments

An employer shall not be entitled otherwise than in pursuance of an agreement or a judgment of the Court to end or diminish a half-monthly payment except where —
the workman, to the prejudice and without the knowledge and consent of the employer, absents himself in such a manner that any notice under this Law cannot be served on him;
the workman assumes work at the rate of wages which he was earning before the accident;
a workman in receipt of a half-monthly payment in respect of total incapacity has actually returned to work;
the monthly wages of a workman in receipt of a half-monthly payment in respect of partial incapacity have actually been increased; or
the workman dies.
