Power to make regulations

The Cabinet may, on the recommendation of the Office, make regulations —
facilitating —
the investigation of; or
the bringing of criminal proceedings in respect of,
the operation of any part of the water supply or wastewater infrastructure of the Islands that may be, or is, an offence under this or any other Law;
regulating service providers' rights to installations on the land or property of other persons or authorities and ancillary rights;
prescribing the explicit provisions for the mechanism for, and the associated terms where, compulsory divestment of assets is to be instituted;
prescribing matters for the better carrying out of the duties and powers of the Office; and
prescribing regulatory and licence fees and any other fees duly payable to the Office.
Regulations made under this section may provide that the contravention of any provision constitutes an offence and may prescribe penalties for any such offence not exceeding the maximum fine and term of imprisonment prescribed in this Law for any offence under this Law.
The Office may, in accordance with this Law, make rules —
relating to penalties payable under this Law;
relating to the operation of critical national infrastructure;
relating to service standards; and
prescribing criteria for charging for the collection, treatment and disposal of wastewater via a system other than the public wastewater system.
