There is established a body corporate called the Water Authority which shall, subject to any policy directives issued to it by the Cabinet, exercise such functions through the Islands as are assigned to it by this Act.
The affairs of the Authority shall be managed by a Board consisting of —
a Chairperson appointed by the Cabinet; and
not fewer than eight and not more than ten other members appointed by the Cabinet for a period not exceeding two years, and three other public officers as defined in the Public Service Management Act (2018 Revision).
The Director shall be one of the three public officers appointed under subsection (2).
The public officers under subsection (2) shall not be entitled to vote.
No member of the Authority shall be personally liable for any act or default of the Authority done or omitted to be done in good faith in the course of the operations of the Authority.
Subject to this section, the constitution and procedure of the Authority shall be in accordance with the Schedule.
The Authority shall have perpetual succession and a common seal, power to enter into contracts and to sue and be sued in its corporate name and shall have power to acquire and dispose of all kinds of property moveable or immovable and to do and perform such acts and things as may be allowed under this Act and the seal shall be authenticated by the Chairperson and one of the members authorised by the Authority in that behalf; and documents not required by law to be under seal may be signed by the Chairperson or the secretary.
