Duties of statutory authorities and government companies

Subject to subsection (2), a statutory authority or government company shall —
supply outputs that the Cabinet has agreed that it will purchase from the statutory authority or government company;
supply outputs to entities or individuals other than the Cabinet for payment and in accordance with agreements with those entities or individuals; and
achieve the ownership performance that it has agreed with the Cabinet that it will achieve during the year.
A statutory authority or government company shall not produce an output during a financial year unless —
the output is within the nature and scope of the activities that are set out in the ownership agreement of the authority or company; and
the Cabinet, or another entity or person has, by way of formal agreement, agreed to pay for the full cost of the output to be produced.
In the event of any inconsistency between subsection (2) and the operation of any other law, subsection (2) shall prevail to the extent of the inconsistency.
