261. (1) A person who, when not at that person’s place of abode, has with that person any article for use in the course of or in connection with any burglary, theft or cheat commits an offence and is liable to imprisonment for three years. Where a person is charged with an offence under this section, proof that that person had with themselves any article made or adapted for use in committing a burglary, theft or cheat shall be evidence that the person had it with them for such use.
Any person may arrest without warrant anyone who is, or whom the person with reasonable cause suspects to be, committing an offence under this section.
In this section — “cheat” means an offence under section 247.
