Aggravated trespass

278. A person who, in the course of committing a criminal trespass —
has in that person’s possession any firearm, offensive weapon, explosive or implement of housebreaking;
has in that person’s possession any gin, trap, or other device for ensnaring, catching or killing any animal, fish or bird;
does or intends or attempts to do any damage to any living or inanimate thing being part of the land or lying thereon or adhering thereto; or
deposits or intends or attempts to deposit any sewage, garbage or other foreign or offensive matter on the land, Section 279 Penal Code (2026 Revision) Page 122 Revised as at 31st December, 2025 c commits aggravated criminal trespass and is liable to imprisonment for four years in addition to any punishment to which that person may be liable under this or any other law.
