The Registrar shall not issue a penalty notice to a controller with respect to a contravention of this Law after the end of a period of three years commencing on the date that the Registrar first became aware of the contravention.

For the purposes of subsection (1), the Registrar is deemed to have become aware of a contravention if the Registrar has received information from which the contravention can reasonably be inferred.
