A person who —
intentionally obstructs a surveyor of ships in the exercise of the powers of the surveyor of ships or fails to comply with a requirement made under section 415;
intentionally obstructs an inspector in the exercise of any power available to the inspector under section 416;
intentionally obstructs an inspector of marine casualties in the exercise of any power available to the inspector under section 416 or section 417;
without reasonable excuse, does not comply with a requirement imposed under section 416 or section 417 or prevents another person from complying with such a requirement; or
without prejudice to paragraph (c), makes a statement or signs a declaration which the person knows is false, or recklessly makes a statement or signs a declaration which is false, in purported compliance with a requirement made under section 417(2)(b), commits an offence and is liable —
on summary conviction, to a fine of ten thousand dollars; or
on conviction on indictment, to a fine of twenty thousand dollars and to imprisonment for one year.
Nothing in section 416 or 417 shall be taken to compel the production by a person of a document of which the person would be entitled to withhold production on an order for discovery on grounds of legal professional privilege.
A person who complies with a requirement imposed on the person under section 416(3)(h) or (i) or section 417(2)(b) shall be entitled to recover such sums in respect of the expenses incurred in complying with the requirement as may have been reasonably incurred.
Any payments under subsection (3) shall be made out of money provided out of the revenue of the Islands.
