Use of unsafe lighters, etc.

A person who uses or causes or permits to be used in navigation any lighter, barge or like vessel when, because of —
the defective condition of its hull or equipment;
overloading or improper loading; or
under manning, the vessel is dangerously unsafe, commits an offence and is liable on summary conviction to a fine of twenty thousand dollars and to imprisonment for six months.
This section does not affect the liability of the owners of any lighter, barge or like vessel in respect of loss of life or personal injury caused to any person carried in the vessel.
