Per diem penalty cap

Notwithstanding any provision of this Act which prescribes a specific per diem penalty in respect of a default under this Act , in any case where —
the per diem penalty for a particular default is —
less than two hundred dollars and the aggregate amount of the per diem penalties in respect of such default has exceeded one thousand dollars; or
two hundred dollars or more and the aggregate amount of the per diem penalties in respect of such default has exceeded the amount of five thousand dollars; and
the Registrar is satisfied that the default is not due to wilful default, it shall be lawful for the Registrar to accept, at any time, payment of a penalty in the amount of one thousand dollars or five thousand dollars, as the case may be, in respect and in lieu thereof.
