Crown Counsel to submit application

In relation to any matter, a Crown Counsel shall, where he is satisfied that the circumstances so warrant, prepare and submit an application in the prescribed form to the Centre for a prospective applicant's entry into the Programme.
An application referred to in subsection (1) shall be made after a Crown Counsel has consulted with the Director of Public Prosecutions in respect of any criminal matter, or with the Attorney General in respect of any civil matter, and has —
in the case of a prospective participant who is likely to be a witness, formed the opinion that —
the testimony of the prospective participant is credible and essential; and
the prospective participant can be relied upon to give the testimony; or
formed the opinion that a witness or his associate, is in need of protection or assistance or both.
An application under this section shall be accompanied by detailed information on —
the significance of the case;
the prospective defendant; and
the testimony of the prospective participant.
