Helping asylum-seeker to enter the Islands

A person who —
knowingly and for gain, facilitates the arrival in the Islands of an individual; and
knows or has reasonable cause to believe that the individual intends to apply for asylum under section 84(1), commits an offence.
Subsection (1) does not apply to anything done by a person acting on behalf of an organisation which —
aims to assist individuals seeking asylum pursuant to the Refugee Convention; and
does not charge for its services.
