In this Act —
means 5th January, 2009;
means matter that is exempt from disclosure, whether or not the rest or part of the rest of the record is liable to disclosure;
means a record referred to in Part III;
includes the Government of the United Kingdom of Great Britain and Northern Ireland and its Overseas Territories other than the Government of the Cayman Islands;
means a company in which the government has a controlling interest and includes a subsidiary of such company;
in relation to a record that is liable to production under this Act, means in a public authority's possession, custody or control;
means the Minister or the Official Member responsible for a public authority that holds a record;
means the person appointed by the Governor under section 3 of the Ombudsman Act, 2017 [Law 23 of 2017];
means —
a ministry, portfolio or department;
a statutory body or authority, whether incorporated or not;
a government company which —
is wholly owned by the Government or in which the Government holds more than fifty percent of the shares; or
is specified in an Order under section 3(2); or
any other body or organisation specified in an Order under section 3(2);
means information held in any form including —
a record in writing;
a map, plan, graph or drawing;
a photograph;
a disc, tape, sound track or other device in which sounds or other data are embodied, whether electronically or otherwise, so as to be capable (with or without the aid of some other equipment) of being reproduced therefrom;
any film (including microfilm), negative, tape or other device in which one or more visual images are embodied whether electronically or otherwise, so as to be capable (with or without the aid of some other equipment) of being reproduced therefrom, held by a public authority in connection with its functions as such, whether or not it was created by that authority or before the commencement of this Act;
means a decision made in relation to the disclosure or otherwise of a record.
