Where a document, record or information is required or permitted by any statutory provision, rule of law, contract or deed to be in writing, or is described in any statutory provision or contract as being written, that requirement, permission or description may be met by information in the form of an electronic record.
Subsection (1) shall apply if the requirement for the document, record or information to be in writing is in the form of an obligation or if the statutory provision, rule of law, contract or deed provides consequences if it is not in writing.
