The Cabinet may, after consultation with the Commissioner and such other persons that the Cabinet may consider appropriate, make regulations prescribing the types of processing that require the prior approval of the Commissioner, being processing that is considered particularly likely to —
cause substantial damage or substantial distress to data subjects; or
otherwise significantly prejudice the rights and freedoms of data subjects.
