The chief officer, in accordance with the Public Service Management Act (2018 Revision) may, in the chief officer's discretion, appoint such persons to be officers of Customs and Border Control upon special contractual terms or such general terms as the chief officer may, by regulations, determine.
Persons appointed under subsection (1) shall be called customs and border control officers ("officers").
Every police officer shall assist in the enforcement of the law relating to any assigned matter and, for this purpose, every constable shall be ex-officio a customs and border control officer.
The following persons, namely —
a member of the Regiment under the Defence Act, 2020;
a prison officer appointed under section 5 of the Prisons Act (2021 Revision); or
a public servant as defined under the Public Service Management Act (2018 Revision),
may assist, at the request of the Director, in any assigned matter as the need arises, and, for this purpose, shall —
subject to subsection (5), have the entitlement of an officer under section 11(4); and
have the power of an officer to detain under section 99(1),
and at all times shall be under the direction of the Director or the Director's delegate when carrying out those assignments.
Where the person under subsection (4) is a public servant, the entitlement under subsection (4)(c)(i) is limited to those public servants who already have an entitlement to carry arms in the performance of their duties.
